Terms & Conditions

This Agreement applies to all members of the Guest’s party no matter the age or affiliation.  Guest acknowledges that Guest is responsible for sharing the renter agreement, and its requirements, with all members of the Guest’s party and anyone else, permitted onto the Rental Property by the Guest.

In consideration of the rent received and the mutual promises contained herein, Owner of the Rental Property does hereby lease and rent to Guest(s) such Rental Property under the following terms and conditions:

  1. The Rental agreement must be signed within 48 hours of booking the cabin otherwise booking will be canceled. In the event that checkin is less than 48 hours away, the rental agreement must be signed within 24 hours prior to check-in time.
  2. Guest agrees to abide by all rules and regulations contained herein or posted on the premises related to the Rental Property.  Guests obligations include but are not limited to keeping the premises as clean and safe as the conditions of the premises permit and causing no unsafe or unsanitary conditions in the common area and remainder of the premises that Guest uses.  Guests agree not to use the premises for any commercial activities or purpose that violates any criminal law or governmental regulation.  Guest’s breach of any duty contained in this paragraph shall be considered material and shall result in the termination of guest occupancy with no refund of any kind.
  3. In no event shall the Rental Property be occupied by more persons than the capacity of the property as stated on the website or the confirmation messages, without prior approval by Owner.  No fraternities, school, civic, or other non-family groups are allowed unless Owner grants prior approval.  In no event shall Guests assign or sublet the Rental Property in whole or in part.  Violations of these rules are grounds for expedited eviction with no refund of any kind.  Guests hereby acknowledge and grant specific permission to Owner to enter premises at any time for inspection purposes should Owner reasonably believe that Guests are causing or have caused any damage to Rental Property.  Guest further agrees to grant Owner access to Rental Property for purposes of maintenance and repair.  If listed as “For Sale”, Guests agree to grant access by scheduled appointment upon notification.
  4. In the event Guest wishes to terminate this agreement, Travel Insurance, Damage Protection and any processing or administrative fees are non-refundable.  The refund policy is as follows:

    Strict 14: Free cancellation for 48 hours, as long as the guest cancels at least 14 days before check-in. After that, guests can cancel at least 7 days before check-in and get a 50% refund of the nightly rate, and the cleaning fee.

  5. A payment of 100% is taken by Owner at the time of the booking.  Any remaining balance must be paid days prior to the arrival date, or this Agreement may be cancelled by the sole option of the Owner.  An automatic credit card payment for the remaining balance will be scheduled by the Owner to be made days prior to the arrival date.  The credit card of the first payment is used if a credit card was provided.  If the automatic payment fails for any reason, it is the responsibility of the Guest to make sure that the remaining balance is promptly paid in full, or the reservation will be canceled with no refund of payments made.  All policies contained in this Agreement shall apply equally to payments made by credit card, check or cash and whether made via website, by phone or in person. Any refunds due to Guests from a credit card payment will be refunded by credit card transaction; all other refunds will be made within 30 days by check.
  6. A security deposit is required (“Security Deposit”) and will be automatically reserved for the booking.  The automatic reserve is conducted by putting a hold or charge on the Guest’s credit card for the amount of $0.00 exactly 5 day(s) prior to the arrival date.  The credit card of the last successful payment will be used.  If there are no successful credit card payments, it is the responsibility of the Guest to send $0.00 by check to the Owner to satisfy the Security Deposit requirement.  If, at the end of the rental period, the rental property is returned undamaged beyond normal wear and tear, the Security Deposit will be released in full within 7 days.  In the event of any damages, Owner will provide Guest with a full accounting of expenses incurred and deductions made from the Security Deposit.  Should the damages exceed the amount of the Security Deposit, Guest agrees to pay the balance within 7 business days after receiving notification.  Deductions from Security Deposit may include, but are not limited to: excess cleaning fee, hot tub draining and refilling fee, trash removal fee, missing item replacement costs, damaged item replacement or repair costs, repair costs of buildings or grounds, or other service call fees.  Owner is under no obligation to use the least expensive means of restoration.
  7. Regular payments and security deposits for the booking will be displayed as ALTA HAVEN – CABIN on the Guest’s credit card statement.
  8. The principal Guest is at least twenty-one (21) years of age and acknowledges that they may be asked to provide proof of age when the Reservation is made. The principal Guest is responsible for all other guests and visitors of the Rental Property during the Reservation. If the principal Guest is not twenty-one (21) years or older, The Host reserves the right to terminate the Reservation without a refund. Sub-letting or parents renting for their children under the age of 21 is NOT permitted. Guests under the age of eighteen (18) are allowed but must be accompanied by a parent or legal guardian over the age of twenty-five (25) and under no circumstances be left alone in the cabin. No student groups or house parties of any kind.
  9. The Host does not allow ANY animals or pets. If evidence of any animal or pet is discovered, the Guest will be responsible for additional costs to fumigate, deep clean the cabin, and repair any damaged property. If you have service animals please inform the Owner at the time of booking. If permission is not given by the Owner, any animals or pet(s) found in or about the Rental Property will be grounds for expedited eviction and forfeiture of all monies paid plus an extra charge with a minimum of $500. 
  10. Guests may check-in at any time after 4:00 PM on the Mar 19, 2023, and the Guest shall check-out no later than 10:00 AM on the Mar 25, 2023. While we make every effort to have your cabin ready, there may be a delay during peak season, and your patience is appreciated. The Owner reserves the right to change the check-in and check-out times, in which case(s) Guest shall be given a minimum of twenty-four (24) hour notice of the said change.
    1. No Check-in or Check-out on the following holidays:
      1. Easter Sunday
      2. July 4th
      3. Thanksgiving Day
      4. Christmas Day
      5. New Year’s Day
  11. No refunds will be provided due to inoperable appliances, hot tubs, electronics, gas fireplaces, HVAC, etc.  The Owner will make every reasonable effort to assure that such appliances will be and remain in good working order.  No refunds will be given to events out of the owner’s control, including but not limited to power blackouts, water shortages or outages, flooding, snow, construction at adjacent properties, or mandatory evacuations of the area by county officials due to hurricanes or other potentially dangerous situations arising from acts of god or nature. Guest hereby agrees and acknowledges that Guest shall not be entitled to a refund in the event Guest departs before the end of the Reservation or in the event Guest arrives late or does not arrive for the Reservation. 
  12. Guest hereby agrees that The Owner or its agents may enter the Rental Property to make necessary repairs or maintenance in and around the Rental Property. The Host shall make every effort to have the repairs done quickly and efficiently. Furthermore, The Host does not guarantee against mechanical failures in the heating, air conditioning, television, fiber cable box, or any other appliances. If an appliance or system is inoperative or pre-existing damage is observed, the Guest shall contact The Host immediately. If not reported, we must assume the damage or loss occurred during your occupancy, and we must charge you. Should a maintenance specialist make a service call and find that the equipment is in working order and the problem is due to the Guest’s oversight or neglect, the charge for the service call shall be the responsibility of the Guest.
  13. The cabin is on a private well and septic system. ONLY FLUSH toilet paper and body waste down the toilet. DO NOT FLUSH paper towels, wipes of any kind, sanitary products, condoms, diapers, or anything other than body waste and toilet paper. If it is found that anything other than toilet paper was flushed (diapers, wipes, feminine products, etc.) and the plumbing system is clogged, you could be charged up to $1000 in damages. Please be respectful of water usage and do not leave the water running for long periods of time. Additionally, there is no garbage disposal. Please dispose of food waste in the trash and do not force food down the sink.
  14. The Owner shall not be responsible for any personal belongings lost, stolen, or left behind by the Guest or any member of the Guest’s party. Any personal items found in or around the Rental Property shall be held for fifteen (15) days. After fifteen (15) days, any unclaimed items will be discarded or donated. Guest is responsible for all shipping costs for any Lost and Found items that Owner is requested to return to Guest. The Guest will also be charged a $25.00 convenience fee. The Owner will not be responsible for any lost items or damage to the items during shipping.
  15. A hot tub is provided at the Rental Property, it will be prepared and tested for proper and safe chemicals prior to or on the day of occupancy.  Misuse of a hot tub or pool by the spilling of foreign substances into the pool, i.e. soap, shampoo, oils, glass or metal will result in a Service Call Charge at the sole discretion of the Owner.  Under no circumstances are pets allowed in pools or hot tubs. No one under the age of eighteen (18) may use the hot tub without the supervision of a responsible adult.  Violation of this provision shall be grounds for expedited eviction and forfeiture of all monies paid and an additional $500 fee will be charged. 
    1. Absolutely no food or glass is allowed near the hot tub.
    2. Guest agrees to rinse prior to using the hot tub to wash off any lotions.
    3. If the Guest requests an additional hot tub service during the Guest’s stay, the Guest shall be charged $150.
    4. Guest acknowledges that the hot tub cover must be replaced while not in use and before check-out.
    5. Guest understands that adjusting the temperature of the hot tub to the highest setting will result in the high limit switch shutting off the power to the hot tub and will render the hot tub unusable. In this event, a technician must make a service call to correct the problem, and the Guest shall be charged for the service.
  16. The burning of candles is prohibited in or around the Property.
  17. An indoor fireplace is provided at the Rental Property. The indoor fireplace is gas fueled and is only available between October 1st – April 1st. ABSOLUTELY NOTHING SHOULD BE PLACED INTO, AROUND, OR NEAR THE FIRE – this includes but is not limited to items such as – sticks, paper, plastic, wood, charcoal, lava rocks, marshmallows, and any other combustible material. Failure to adhere to this could cost additional cleaning fees of $100 or actual costs to replace the fireplace mechanism(s) in the event of damage to the unit. DO NOT MOVE OR REARRANGE THE LOGS. Please leave pilot lights on unless otherwise instructed. The fireplace should not be left unattended and should be turned off when sleeping and upon leaving the premises. Please don’t have the fireplace on while running the air conditioning. 
  18. Outdoor fires are only permitted inside the fire pit only. The fire pit may be used year-round. Never leave a smoldering or burning fire unattended. No lighter fluid is allowed. Guests are responsible for providing their own firewood. Only wood may be burned in the fire pit; no trash or other materials are permitted. You must clean up the area surrounding the firepit before you check out all waste, such as but not limited to – cans, bottles, cups, wrappers, and all other trash. All fires must be extinguished upon check-out, and anytime you leave the Rental Property. Use of fire extinguishers for non-emergencies shall be charged $150.
  19. All garbage must be bagged and removed from the inside of the Rental Property. The Rental Property has outdoor containers for Guests to use to dispose of waste. If the garbage generated during the Guest’s stay exceeds the amount that will fit in these containers, the Guest shall be responsible for disposing of the excess garbage or can arrange with the Owner for garbage collection for a fee of $20. Guest acknowledges that leaving garbage outside the designated container(s) may attract unwanted animals. In the event, Guest leaves garbage outside of the designated containers, and any clean-up is necessary, the Guest shall be assessed a minimum clean-up fee of $100. If the outdoor container(s) are filled upon the Guest’s arrival, the Guest shall contact The Owner immediately.
  20. The property is strictly non-smoking/non-vaping. Smoking/Vaping outside of the physical property is allowed unless stated otherwise. Smoking/vaping is not permitted on any of the deck areas. Please be neat in disposing of cigarette butts. Do not discard them around the property driveway or yard. If it is discovered you have smoked in the property or on any of the decks, a minimum $500 fine will be assessed to cover additional professional cleaning of carpets and upholstery.
  21. The use of firearms or fireworks is strictly prohibited. Any violators of this provision shall be asked to vacate the Rental Property immediately without a refund.
  22. The security of our properties is a top priority. The Guest agrees to ensure that all locks on doors (including dead bolts) and windows MUST be locked anytime you leave the Rental Property, especially upon departure. If any door locks (including dead bolts) or window locks are found unlocked or open after your departure, and the Rental Property is compromised, you will be held responsible. We appreciate you helping us keep the properties safe. The property is protected with outdoor cameras. The cameras are only on the property’s exterior and are there to ensure the safety of the property. This home is equipped with a device that monitors the environment inside the property (including noise levels, temperature, and motion) to ensure guests have a pleasant stay and that our neighbors are not disturbed.
  23. The guest agrees to not move any cabin furniture as this may scratch the floor, causing damage. If the furniture or floors are damaged during your stay, you will be held responsible and charged accordingly.
  24. Please understand that noise travels in the mountains and be courteous of neighbors’ right to the enjoyment of a peaceful mountain experience. No noise shall be heard at a neighboring house after 10:00 PM. A maximum of 2 warnings per stay. Further infractions will result in eviction without a refund.
  25. Guest also agrees to indemnify Owner from and against liability for injury to Guest or any other person occupying Rental Property resulting from any cause whatsoever including, but not limited to, an injury sustained as a result of the use of the spa, hot tub, sauna, whirlpool tub, pool, exercise equipment, elevator, etc. except only such a personal injury caused by the gross negligence or intentional acts of the Owner.
  26. Owner may terminate this Agreement upon the breach of any of the terms hereof by Guest.  Guest shall not be entitled to the return of any rental monies paid under the terms of this Agreement and shall vacate the Property immediately.
  27. The agreement shall be enforced under the laws of the state within which the Rental Property is located, including any applicable rental acts of that state, and represents the entire Agreement.  Any amendments must be in writing and signed by both parties.  In the event of a dispute, legal action may only be instituted in the county within which the Rental Property is located.  If any part of this Agreement shall be deemed unenforceable by law, that part shall be omitted from this Agreement without affecting the remaining Agreement.
  28. The Rental Property may offer access to recreational and water activities, including but not limited to canoes, bicycles, and swimming.  Guest fully understands and acknowledges that outdoor recreational and water activities have inherent risks, dangers and hazards.  Participation in such activities and/or use of equipment may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability.  Guest agrees to fully indemnify and hold harmless the Owner and any and all agents, employees, or contractors for any injury or damage caused by these activities, whether caused by the negligence of the Owners, the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes foreseeable or unforeseeable.  Guest hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the Owners or by any other person.  Guest hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Owner and any and all agents, employees, or contractors from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of Rental Property facilities, equipment, or activities.  Guest further assumes full responsibility for the actions of any and all persons whom he may allow to enter the property during the rental period and indemnifies Owner from any and all claims arising from such other persons.
